Terms & Conditions – One Acre Property Listings
By accessing One Acre Property Listings Ltd. (“One Acre,” “we,” “us,” or “our”) through our website, phone, e‑mail, social media, in‑person consultation, or any other channel, you (“Client,” “User,” or “Buyer/Seller”) agree to be bound by these Terms & Conditions (“T&Cs”). One Acre reserves the right to amend these T&Cs at any time. Changes become effective upon posting; continued use of our services constitutes acceptance of the revised terms.
One Acre provides an online and offline marketplace for the advertising, promotion, and facilitation of the sale or purchase of land parcels—each measuring one acre or more—in and around Konza, Kenya. We are not a brokerage or legal representative; rather, we curate listings, verify documentation to the best of our ability, and connect qualified buyers and sellers. Title registration, conveyancing, due‑diligence, and all legal or regulatory filings remain the responsibility of the contracting parties and their chosen professionals.
Seller’s Warranty – Sellers represent that all information provided (title status, acreage, boundaries, encumbrances, pricing, and availability) is true, complete, and not misleading.
Buyer’s Acknowledgment – Buyers must conduct independent surveys, searches, environmental checks, and valuation reports before committing to any purchase.
Availability – Land may be withdrawn, sold, or repriced without prior notice. One Acre is not liable for transactions that fail due to changes in availability or terms beyond our control.
Site visits are arranged on a first‑come‑first‑served basis. To secure a visit slot, clients may be required to:
Provide a copy of national ID/Passport for security vetting;
Pay a refundable visitation fee (credited toward the purchase price if a sale is concluded, otherwise refunded less administrative charges).
Late cancellations (< 24 hours) may attract a non‑refundable logistics fee to cover fuel and field staff costs.
Listing Fee (Sellers) – Standard or premium packages are invoiced upfront and are non‑refundable once a listing goes live.
Marketing / Documentation Fee (Buyers or Sellers) – Optional services (drone footage, legal-liaison, survey coordination) are billed as quoted and payable on acceptance.
Commission – Where expressly agreed, One Acre may charge a success‑based commission, payable at closing and deducted by the transacting advocate or escrow agent.
All payments are accepted via bank transfer, M‑Pesa, or approved mobile‑money channels. Late payments incur interest at 2% per month, or the maximum amount permitted by law.
Buyers – Reservation or deposit fees are refundable only in accordance with the signed sale agreement or reservation letter.
Sellers – Listing fees are non‑refundable after publication; however, listings may be paused or edited upon written request.
Force Majeure – Neither party shall be liable for delays or non‑performance due to events beyond reasonable control (e.g., acts of God, government restrictions, civil unrest).
Users agree not to:
Post fraudulent, misleading, or defamatory content;
Interfere with the platform’s operation or security;
Solicit One Acre employees for private work outside the platform.
Any suspected fraud will be reported to the relevant authorities.
One Acre makes reasonable efforts to verify listings but disclaims all express or implied warranties as to accuracy, fitness for a particular purpose, or non‑infringement. Users agree to indemnify and hold One Acre harmless from any claim, loss, or damage (including legal fees) arising out of listings, transactions, or use of the platform, except where caused by One Acre’s proven gross negligence or willful misconduct.
All website content, branding, photographs, and marketing materials remain the intellectual property of One Acre or our licensors. Unauthorized reproduction, scraping, or distribution is prohibited.
We process personal data in accordance with Kenya’s Data Protection Act 2019. Our full Privacy Policy is available on the website and forms part of these T&Cs.
These T&Cs are governed by the laws of the Republic of Kenya. Disputes shall first be attempted to be resolved amicably; failing which, they shall be referred to arbitration in Nairobi under the Chartered Institute of Arbitrators (Kenya) rules. The arbitral award shall be final and binding.
